TRANSPORT AND TRANSFER OF RISKS
1. All items must depart from the Seller's warehouse.
The place of performance for all services under the Supply Contract is the address of the Seller's warehouse.
2. The Buyer bears the shipping costs, including all incidental costs (such as customs duties and packaging).
3. With the transfer of the items to the Buyer, the freight forwarder, the courier or any other individual or entity responsible for carrying out the shipment, in any case not before departure from the warehouse, the risks are transferred to the Buyer.
The Seller is responsible only for defects regarding the packaging of the product, its shipping or the choice of means or transport route.
4. The Seller is obliged to insure transport only if the Buyer expressly requests it.
The costs are borne by the Buyer.
5. If the shipment of the goods is delayed for a reason that is not the responsibility of the Seller, the risk is transferred to the Buyer as soon as the shipment is notified that the shipment is ready to depart.
In this case, the Seller has the right to put the item back on delivery at the Buyer's expense and risk and at the Seller's discretion and demand immediate payment of the invoice amount.
6. If the Buyer does not accept the items shipped or does not accept them in time, the Buyer will have to bear all the consequent and additional transport costs and will bear the storage costs.
The Seller reserves the right to charge these costs separately.
DELIVERY TIME:
If the Seller is late with a delivery, they will be given an additional 18 days to deliver. At the expiration of these additional days, if delivery has not yet been made, the Buyer has the right to withdraw from the contract only and limited to the part of the delivery obligation that has not yet been satisfied, if the Buyer communicates to the Seller for registered who will refuse to fulfill the contractual obligations if, after the expiry of the further 18 days, the delivery has not yet been made.
In this case, the Buyer can only request compensation for non-performance instead of exercising the right of withdrawal if the Seller has intentionally or through gross negligence caused the delivery delay.
In exceptional cases, in case of delay in partial delivery due to the Seller, the Buyer has the right, under the above conditions, to withdraw from the entire contract or request compensation due to failure to fulfill the delivery obligation, if the Partial fulfillment of the contract is of no interest to the Buyer, applying rigorous evaluation criteria.
